Official Rules Orlando Sentinel Father of the Year Contest Official Rules 1. NO PURCHASE NECESSARY. The “Orlando Sentinel 2009 Father of the Year Contest” (“Contest”) is sponsored by the Orlando Sentinel, 633 North Orange Avenue, Orlando FL 32802 (“Orlando Sentinel”) and Shoot Straight, 1349 S. Orange Blossom Trail, Apopka, FL 32703 (collectively “Sponsors”). The Contest will begin on May 4, 2009 at 10:01 a.m ET and end on June 15, 2009 at 11:59 p.m. ET. The geographical scope of this Contest is the following counties in Florida: Orange, Seminole, Osceola, Volusia, Polk, Brevard, Lake, Marion, and Sumter. 2. Contest void where prohibited or restricted by law. By entering this Contest, all contestants agrees to these Official Rules and to the decision of Sponsors and the Contest Judges, which are final in all respects. Eligibility 3. To be eligible to enter a father (each a “Nominee”) in this Contest, you (each “you” or “Entrant”) must satisfy all of the following eligibility requirements as of the date of entry: (a) You must be 13 years or older; (b) you and your Nominee must be legal U.S. residents of any of the following counties in Florida: Orange, Seminole, Osceola, Volusia, Polk, Brevard, Lake, Marion, and Sumter; (c) your Nominee must be a father legally residing of the following counties in Florida: Orange, Seminole, Osceola, Volusia, Polk, Brevard, Lake, Marion, and Sumter; (d) neither you nor your Nominee nor any of your immediate family members may be currently employed by Sponsors or their respective parent companies, advertising companies, affiliates, subsidiaries, promotion and delivery contractors and/or public relations companies or any other entity that participated in the creation, operation or fulfillment of this Contest. "Immediate family" includes only spouses, parents, siblings and children. Entry 4.This Contest consists of three (3) stages: Entries will be accepted starting on May 4th, 2009 at 10:01 a.m. ET and ending on June 4, 2009 at 11:59 p.m. ET (“the Entry Period”). All Entries that are timely submitted and satisfy the Submission Requirements of these Official Rules will be published on orlandosentinel.com/father for public voting beginning June 5, 2009 at 10:01 a.m. ET and ending on June 15, 2009 at 11:59 p.m. ET (“Voting Period”). The Grand Prize Winning Nominee (the “Grand Prize Winner”) will be determined and announced no later than June 21, 2009. Stage 1: Entry Period: To enter a father as a Nominee, go to orlandosentinel.com/father during the Entry Period and follow the instructions to submit your Nominee for Central Florida’s 2009 Father of the Year Contest. Your Entry must include a statement describing why you feel your Nominee is deserving of the award (“the Story”) and an original unpublished photograph of your Nominee (“the Photo”) and both the Story and the Photo must satisfy the “Submission Requirements” below. Entries must include your full name, your Nominee’s full name, your city and state of residence, your email address, and your phone number. Entries are only complete when the confirmation box alerts you that your submission has been successfully uploaded. Entries will not be accepted via regular mail or any other method. Entries must be received no later than June 4th, 2009 at 11:59 p.m. ET. You may submit only one (1) Entry per Nominee. No group submissions will be accepted. All Entries become the property of the Orlando Sentinel and will not be returned. Sponsors assume no responsibility for lost, illegible, disqualified, incomplete, damaged, late or misdirected entries, all of which will be void. The Nominees of any Entrants who fail to provide all required information or adhere to the above guidelines or these Official Rules in any way, as determined by the Orlando Sentinel in its discretion, may be disqualified and such Entrants and their Nominees may not be notified by Orlando Sentinel. Stage 2: Voting Period: All Entries that are timely and properly submitted during the Entry Period will be published on orlandosentinel.com/father for public voting during the Voting Period. During the Voting Period, visit orlandosentinel.com to view all properly submitted Entries and to vote for your favorite Entry. All web site visitors (including Entrants and Nominees) may vote for their favorite Entry during the Voting Period. Voting is limited to one vote per IP address per day. Stage 3: Grand Prize Winner Determination: Following the conclusion of the Voting Period, on June 15th, or within a reasonable time thereafter, a designee of the Orlando Sentinel will review the tabulation of the votes received at orlandosentinel.com/father using the web site’s online voting tool, to identify the Nominee who received the highest number of votes during the Voting Period. Subject to verification of eligibility, the Nominee who receives the highest number of votes during the Voting Period, determined by the web site voting tool, will be declared the Grand Prize Winner. In the event of a tie, the voting period will be extended 24 hours. This process will continue as necessary until any such tie is broken. Submission Requirements 5.Story may discuss topics including, not limited to, the Nominee’s personality traits, community involvement, or other extraordinary accomplishments. Story must be your original unpublished work, must be written in English and free of any text formatting (bold, italics, etc.). Photo must depict only your Nominee and no other person, must be an original unpublished photograph, JPEG format only, at least 300 dpi (1200 x 1200) and no larger than 10MB. You may send black and white or color photos. Do not submit copyrighted photographs, such as professional portraits, unless you are the photographer who took the portrait photograph. Photos may not be digitally altered or enhanced, except that images may be cropped and rotated as necessary as long as the rectangular format is maintained and the size is within the specifications above. Sephia-toned and duo-toned images will not be accepted. Artistic filters are not permitted. No borders or frames may be added to images. No watermarks, signatures, or copyright notices may be added to the photographs. Adding or replacing elements in any photographs is not permitted. Photos containing nudity will not be eligible. Any Photo or Story that is otherwise determined by the Orlando Sentinel in its discretion to be in poor taste may be rejected and the accompanying Entry disqualified. Warranty & License by Entrant 6.By submitting a Story and Photo, each Entrant warrants that the Story and Photo are original, were written and/or taken solely by the Entrant, do not violate any copyright laws, and do not plagiarize, libel, defame, disparage, slander or otherwise infringe on or violate the rights of any third parties. Each Entrant further certifies that he/she has obtained all necessary and appropriate approvals or consents from all persons and entities participating in or otherwise involved with the creation and production of the Photo and/or Story. Each Entrant agrees to indemnify and hold harmless Sponsors, their respective parent companies and subsidiaries, and their respective officers, directors, employees and affiliated organizations, from and against any and all claims, demands, damages, costs, liabilities and causes of action of whatsoever nature that are based upon or arise out of any breach by the Entrant of these Official Rules or the warranties and representations made in this paragraph. 7.By entering this Contest, each Entrant grants to Sponsors on his/her behalf and on behalf of his/her Nominee, if required, permission for the Story and Photo to be published by the Orlando Sentinel and to be publicly displayed on the web site(s) of the Orlando Sentinel (including without limitation orlandosentinel.com/father), during the Voting Period (and thereafter with respect to the Grand Prize Winner) without compensation to the Entrant or Nominee. In addition, by submitting a Story and Photo, Entrants warrant that they are legally entitled to submit the Story and Photo in the Contest and that the distribution, reproduction, display and any other uses of the Story and Photo by the Orlando Sentinel as permitted above will not infringe any third party rights, including those of Nominee. Privacy of Information 8.The information that you provide in connection with the Contest may be used by the Orlando Sentinel in accordance with its Privacy Policy, which is found at orlandosentinel.com and which may be updated from time to time. Prize Description/Restrictions 9.Grand Prize (1): Verified Grand Prize Winner will receive a gift certificate redeemable for up to $1,000 in qualifying purchases at the Shoot Straight’s Orlando locations: 1349 S. Orange Blossom Trail, Apopka, FL 32703 and 4700 S U.S. HWY 17-92, Casselberry, FL 32707. Gift certificate expires December 31st, 2009 and is good for in-store merchandise purchases only. Any balance not used during initial purchase is forfeit and will not be carried over or redeemable at another transaction time. Grand Prize gift certificate will be issued the name of the Grand Prize Winner. 10. All details of prize shall be at Sponsors’ sole discretion. No other items or services except for those expressly stated above as part of prize description will be awarded. Grand Prize Winner is solely responsible for any and all taxes, fees, and expenses associated with this Contest and redemption or use of the prize. Prizes are non-transferable. No prize substitutions will be permitted except that Sponsors reserve the right to award an alternate prize of equal or greater value if they deem necessary. 11.Any portion of prize not used by Grand Prize Winner is forfeit and no cash substitute will be offered or permitted. All prizes being offered are provided “as is” with no warranty or guarantee either express or implied by Sponsors. Merchandise prizes carry no warranty other than that offered by manufacturers. Sponsors have neither made nor are responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Other restrictions apply. Notification & Verification of Grand Prize Winner 12. Potential Grand Prize Winner will be notified by an Orlando Sentinel representative via phone and/or email in accordance with the information on the Entrant’s entry form and may be asked to provide Sponsors with valid identification and execute an affidavit of eligibility and, where legal, a publicity release. Acceptable identification includes a valid driver’s license or other valid picture ID showing name and address. Grand Prize Winner may also be required to sign other legal documents, including tax forms and a release supplied by Sponsors that, among other disclaimers, releases Sponsors and a range of subsidiaries, directors, agents, agencies, affiliates, franchisees, promoters, officers, directors, employees and related persons from any and all liability related to this Contest and the receipt and use of any prize. 13.In the event that any potential Grand Prize Winner (a) cannot be contacted directly by a representative of Orlando Sentinel by 5 p.m. two (2) business days following the day contact is first attempted, (b) fails to satisfy any eligibility or verification requirement herein, (c) declines to accept the prize, (d) or is (or his nominating Entrant is) otherwise determined to be ineligible, Sponsors in their discretion may disqualify that individual, and the Nominee who receives the next highest number of votes during the Voting Period will be declared the alternate Grand Prize Winner as soon as reasonably practicable after initial Grand Prize Winner is determined to be ineligible. Alternate Grand Prize Winners are subject to all eligibility requirements of these Official Rules. If any dispute arises concerning the identity of an Entrant based on an email address, the documented owner of the email account from which the Entry was sent shall be deemed the Entrant. 14. The Grand Prize Winner’s Photo and Story submissions will also be published on orlandosentinel.com/father and in the Orlando Sentinel newspaper following the final verification of Grand Prize Winner, which is anticipated to occur on June 19, 2009 or within a reasonable time thereafter. The Orlando Sentinel reserves the right to edit the Story for publication. Publicity Release 15. By accepting a prize, the Grand Prize Winner hereby grants to the Sponsors and their agents (a) permission, without further compensation, to use his name, likeness, photograph, film, voice recording, and image for promotional purposes, and (b) a non-exclusive, perpetual, worldwide, royalty-free, irrevocable license to copy, distribute, display, adapt, publish and make derivative works from the Photo and Story, or any portion thereof, in Sponsors’ marketing materials in any media now known or hereafter created, including publication and distribution of the Photo and Story or portions thereof, on Sponsors’ web sites, without further compensation, if and to the extent allowed by law. Miscellaneous 16. By entering, Entrants and Nominees agree to release Sponsors, any affiliates or prize suppliers from any and all claims, liability, damages, losses or injuries of any kind arising out of their acceptance/possession and/or use/misuse of the prizes and/or their participation in the Contest. 17. The Orlando Sentinel reserves the right to correct typographical or clerical errors in any Contest-related materials. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, the Orlando Sentinel reserves the right to award only the stated number of prizes by selecting the Grand Prize Winner at random from among all legitimate, un-awarded, eligible prize claims. 18. Sponsors are not responsible for Entries that are lost, misdirected, mutilated, incomplete, not legible, if they contain errors or if for any reason they are not received prior to the stated deadline and all such Entries are void. The Orlando Sentinel reserves the right to cancel, terminate or suspend this Contest or any part of this Contest should any non-authorized intervention, network failure, information storage failure, telecommunications failure, malfunction, or other causes beyond its control, corrupt or impair the security, administration, fairness and/or operation of this Contest as determined by the Orlando Sentinel in its sole discretion, at which time the Orlando Sentinel will select the Grand Prize Winner as follows: If the Contest is impaired prior to the commencement of the Voting Period, the Orlando Sentinel at its option may either extend the Contest dates relating to the Entry Period and Voting Period or it may select the Grand Prize Winner at random from all among all non-suspect entries received prior to the event causing the Contest to be impaired. If the Contest is impaired after the commencement of the Voting Period, the Orlando Sentinel at its option may either extend the Voting Period or it may determines the Grand Prize Winner based on the number of non-suspect votes received prior to the event causing the Contest to be impaired. 19. No responsibility is assumed for: any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure; theft or destruction or unauthorized access to, or alteration of, entries; any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, or providers, computer equipment, hardware, or software; failure of any email or electronic entry to be received on account of technical problems or traffic congestion on the internet or at any website; or any combination thereof, including any injury or damage to Entrant's, Voter’s or any other person's computer related to or resulting from participation in or downloading any materials from this Contest. 20. The Orlando Sentinel reserves the right to prohibit any Entrant from participating in the Contest or any Voter from casting any votes during the Voting Period if, at its sole discretion, the Orlando Sentinel finds such Entrant or Voter to be tampering with the entry process, voting process or other operation of the Contest, or if such Entrant or Voter shows a disregard for, or attempts to circumvent, these Official Rules, or acts: (a) in a manner the Orlando Sentinel determines to be not fair or equitable; (b) with an intent to annoy, threaten or harass any other Entrant, Voter, Nominee or Sponsor; or (c) in any other disruptive manner. Collusion between or among any Entrants, Nominees and/or Voters to unfairly affect the outcome of the Voting Process or this Content is strictly prohibited and will result in the immediate disqualification of the relevant Entry. Any person attempting to defraud or tamper with this Contest in any way will be ineligible for prizes and may be prosecuted to the full extent of the law. Tampering includes attempting to enter or vote more than the number of times permitted by these Official Rules including by using an automated device, multiple email addresses or otherwise. Any failure by the Orlando Sentinel to enforce any of these Official Rules shall not constitute a waiver of such Official Rules. 21. ANY ATTEMPT BY AN ENTRANT, VOTER, NOMINEE OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE (INCLUDING THE ENTRY AND/OR VOTING SITES) OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAW AND SHOULD SUCH AN ATTEMPT BE MADE, THE ORLANDO SENTINEL RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Disputes 22. By entering the Contest and/or accepting a prize, Entrants and Nominees agree that (a) any and all disputes, claims, and causes of action arising out of or connected with the Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorneys' fees; and (c) under no circumstances will any Entrant or Nominee be permitted to obtain any award for, and all Entrants and Nominees hereby waive all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses. 23.All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrants, Nominees, Voters or Sponsors in connection with the Contest, shall be governed by, and construed in accordance with the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than the State of Florida. Any legal proceedings arising out of this Contest or relating to these Official Rules shall be instituted only in the federal or state courts located in the State of Florida, County of Orange and the parties consent to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to these Official Rules. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Winner’s List/Official Rules 24.For a copy of the Official Rules or the name of the Grand Prize Winner, send a self-addressed, stamped envelope to “Orlando Sentinel 2009 Father of the Year award,” c/o The Orlando Sentinel, 633 North Orange Avenue, Orlando, FL 32802, specifying either ”Winner’s List” or “Official Rules Request." Grand Prize Winner’s name will be available after July 21, 2009.
